The Crime

Conspiracy is often a felony offense, and it can seriously damage your record and your reputation. In Tennessee, a person may be convicted of the crime of Conspiracy if the state prosecutor proves beyond a reasonable doubt that two or more people:

  1. Acted for the purpose of promoting or facilitating the commission of an offense; and
  2. Agreed that one or more of them would engage in conduct that constitutes the offense.

The Penalties

The penalties for the crime of Conspiracy depend on the circumstances of the offense. A Conspiracy is an offense one classification lower than the most serious offense that is the object of the Conspiracy. Thus, if two or more people are guilty of a Conspiracy to commit a Class B Felony, then the Conspiracy itself would be a Class C Felony.

Other Consequences of a Conspiracy Conviction

In addition to the court-mandated penalties, a person convicted of Conspiracy may also experience serious collateral (other) consequences.
